A London employee may be asked to help a U.S. operation adopt a manufacturing or quality process. The L-1B assessment needs an evidence-based explanation of the employee's knowledge and the work to be performed. Familiarity with a production line is not enough without explaining the relevant organizational knowledge.

IN THIS GUIDE · Connect manufacturing-process knowledge to the specific U.S. implementation

01

State the knowledge claim precisely

The standard addresses special knowledge of organizational interests and their international application, or advanced knowledge of organizational processes and procedures. Explain which aspect is claimed in this assignment. Neither a proprietary label nor a general assertion of experience establishes the complete case.

02

Use actual implementation evidence

Identify work the employee performed in earlier implementations and the records supporting it. Describe responsibilities without overstating ownership of the whole process. If the employee tested one stage, preserve that distinction instead of saying they designed the system.

03

Describe the receiving operation's work

Explain the duties, supervision and any third-party placement involved. Show how the claimed knowledge will be used rather than merely describing why the project is urgent. The case must reflect the actual assignment, including inconvenient facts about control or work location. For an assignment primarily at an unaffiliated employer’s worksite, assess both statutory bars: being controlled and supervised principally by that unaffiliated employer, or an arrangement essentially providing labor for hire rather than a product or service requiring knowledge specific to the petitioning employer. Identify who controls and supervises the work and why the petitioner-specific knowledge is needed; merely naming a proprietary system does not answer those questions.

04

Keep the underlying L conditions in view

Place the implementation records beside the employment calendar. Generally, show one continuous full-time qualifying year abroad within the relevant three years; brief U.S. visits need not break continuity, but U.S. days do not count toward that year. Document the qualifying corporate relationship and regular, systematic, continuous business in the United States and another country. If the U.S. operation has been doing business for less than one year, document sufficient premises and financial ability to pay the employee and commence business; initial new-office approval is limited to one year. These records accompany, rather than replace, the specialized-knowledge evidence.
