Compare a regional leadership offer with a co-owned business proposal

USAvisa field guide · 2 minute readReviewed 7 September 2026
THE SHORT ANSWER

These opportunities involve different facts. Describe the proposed job and the proposed investment independently before comparing immigration options.

01

Document the corporate-transfer facts

Identify the related entities, foreign work history and proposed responsibilities. Explain actual authority rather than relying on the regional title. The L assessment needs the organization and employment conditions as well as the job.

02

Document the co-owner arrangement

Provide the rights, treaty-nationality evidence and lawful funding history for the investment proposal. Assess the business and the applicant's role. Do not substitute an employment offer from another organization for the investor's own evidence. For the transfer, test the full-time continuous qualifying foreign year within the relevant three years and the actual managerial, executive or specialized-knowledge role. Related organizations must meet the continuing-business requirements. For the investment, test treaty nationality and generally 50% treaty-country ownership, lawful committed at-risk capital, substantiality, a real non-marginal enterprise, development and direction, and intent to depart when E status ends. Record which proposal supplies the evidence for each requirement; documents from one deal do not automatically establish the other.

03

Compare the decisions each requires

List unresolved conditions and commitments under each proposal. Include family work plans without assuming identical permissions. Commercial risk and tax planning may need separate professional advice alongside the immigration comparison.
