Do not assume every expense connected with obtaining the money qualifies as investment. Identify each payment and have its treatment reviewed under the actual proposal. The current capital figures are US$1,050,000, or US$800,000 for a qualifying targeted employment area or infrastructure project; scheduled statutory adjustments start January 1, 2027.
Reconcile gross assets with available funds
Record deductions, sale expenses and distributions separately. This helps explain why the inherited asset value may differ from the amount available. The project budget should use accurate figures rather than the highest number in the history.
Reconcile asset value, sale proceeds, deductions, distributions, and the amount reaching the EB-5 enterprise. Only the qualifying capital placed at risk counts toward the investment; obtaining or administering the inheritance does not turn every related expense into invested capital. An ordinary investment requires US$1,050,000; a qualifying rural or high-unemployment targeted area, or an infrastructure project, uses US$800,000. Funds must be invested or actively in the process of investment, and the lawful source and complete path require evidence. The venture must produce ten qualifying full-time American jobs. Avoid using the asset’s headline valuation after transaction costs have reduced available proceeds, and keep professional or official charges outside the capital total.
Hypothetical example: A London agricultural-equipment dealer sells inherited securities to finance a standalone American parts-remanufacturing venture. A worksheet subtracts documented taxes and estate expenses from sale proceeds, records net distribution, and follows it into the company. The Form I-526 plan uses only the amount truly placed at risk. A distinct operating budget supports ten qualifying full-time positions; neither the original portfolio value nor the advisers’ invoices are labelled as business capital.
