Describe it as expected until the relevant events have occurred. Provide the available records and identify the outstanding steps instead of representing the funds as already received.
Separate evidence of entitlement from evidence of payment
Ask the appropriate adviser to explain the distribution documents and any unresolved conditions. Preserve payment records when available. The immigration assessment should follow the real sequence rather than a preferred investment deadline.
Describe an expected distribution with two columns: evidence already available and events still outstanding. Obtain governing instruments, probate filings, fiduciary records, statements, sale documents, calculations, and conditions. Once money moves, preserve statements for every account and explain conversions, deductions, and transfers. EB-5 demands a lawful source and path of funds; an anticipated entitlement is not yet capital invested or actively being invested at risk. The project must meet either the standard US$1,050,000 level or the US$800,000 targeted-area or infrastructure level, and support ten qualifying full-time American jobs. A regional-center investor uses Form I-526E. Avoid writing a projected payment date as though it were a completed transaction.
Hypothetical example: A London construction estimator expects a trust distribution and is reviewing a regional-center infrastructure offering. The estimator supplies the trust instrument, trustee statements, underlying asset-sale records, and a schedule marking the distribution as pending. Project documents and the Form I-526E strategy are evaluated separately. When the trustee pays, the estimator retains the trust-account debit, personal-account credit, and investment transfer. This sequence shows entitlement, receipt, and path without backdating availability to suit a preferred filing plan.
