A patent is not a universal prerequisite. The evidence must establish the relevant special or advanced organizational knowledge and its use in the proposed role, together with the other L requirements.
Describe what the employee understands and applies
Use a real implementation example and supporting records. Avoid turning an ordinary industry qualification into a company-knowledge claim without explaining the difference. The absence or presence of a patent does not settle the full assessment.
Patents are neither required nor sufficient; identify the knowledge and show why it meets the statutory kind. L-1B specialized knowledge means special knowledge of the organization’s products, services, research, equipment, techniques, management, or other interests and their application in international markets, or an advanced level of knowledge of the organization’s processes and procedures. Gather project records, training history, comparisons with industry knowledge, and a U.S. duty description. Also prove the parent, branch, subsidiary, or affiliate link, plus full-time foreign employment lasting continuously for one year in a managerial, executive, or specialized-knowledge capacity within the relevant preceding three-year period. Except under the special U.S. new-office rules, the qualifying organization must do business in America and another country through the stay. Do not equate tenure with petitioner-specific knowledge. The general L-1B maximum is five years, subject to regulatory exceptions and recapture rules.
Hypothetical example: A London water-treatment equipment maker proposes transferring a commissioning specialist who refined its internal membrane-calibration sequence but holds no patent. The company supplies manuals, revisions, training records, and examples of the specialist applying that sequence abroad. It explains the intended American commissioning work and distinguishes the company method from standard trade skills. Ownership records and the employment calendar complete the thresholds; urgency and a proprietary label do not.
