What if a factory implementation is postponed during L-1B preparation?

THE DIRECT ANSWER

Provide the revised assignment and dates for review. A delayed project may affect the planned duties or other relevant facts, even if the company still wants the same employee.

Describe what the employee would do during the delay

Do not leave a gap filled by assumptions about temporary work. Ask the business to explain the actual revised responsibilities. The immigration assessment should address that work, not an obsolete implementation schedule.

Replace the obsolete project calendar with an interim-duty plan and ask whether the assignment still requires company knowledge. Identify the employee’s work location, supervisor, deliverables, customer involvement, and revised implementation date. L-1B supports special organizational knowledge or an advanced level of process-and-procedure knowledge; a delayed launch cannot be filled with generic labour unrelated to that claim. When the employee will be stationed primarily at an unaffiliated worksite, the petitioner must retain principal control and supervision, and the placement must provide a petitioner-specific product or service requiring specialized knowledge rather than labour for hire. Preserve the corporate link, one continuous full-time year abroad in a managerial, executive, or specialized-knowledge capacity within the relevant preceding three-year period, and, outside the special U.S. new-office rules, both-country operations. Avoid assuming that postponement leaves an approved description accurate. Remember the general five-year L-1B limit, subject to regulatory exceptions and recapture rules, when rescheduling.

Hypothetical example: A London aerospace-components maker postpones an American composite-production launch after equipment delivery slips. Its process technician would otherwise arrive months before installation. The company documents a revised remote-validation phase, identifies petitioner managers directing it, and shows how proprietary curing knowledge applies to those tasks. It removes unrelated shop-floor coverage from the proposal and updates dates before filing. If no genuine specialized assignment remains during the gap, commercial urgency does not supply one.
